  1. The Competition is run by Canary Wharf Group.
  2. Eligibility: This Competition is open to residents of the United Kingdom (England, Scotland, Wales, and Northern Ireland) who are 13 years or over, including employees and their immediate families of Canary Wharf Group. Any entrants under 18 years of age must obtain parental consent.
  3. Competition Period: The competition opens at 0:00 on 5 August 2024 and closes at 23:59 on Friday 30 August. Any entries received outside of these times and dates will not be accepted.
  4. Entry Requirements: Internet access and an Instagram account are required to enter. Online entry via Instagram only – all participants must have access to the internet and an active, public Instagram account. Intellectual Property Rights: By participating in the competition, the entrants license and grant Canary Wharf Group exclusive, royalty-free, perpetual, worldwide, irrevocable and sub-licensable right to use, reproduce, modify, adapt, publish and display such content for any purpose in any media, without compensation, restriction on use, attribution or liability. Participants agree not to assert any moral rights in relation to such use where the moral rights in respect of the content are theirs to assert.   7. Entry Restrictions: All entries must be made directly by the person entering the Competition. Syndicated entries or those made using methods such as a computer macro, a script or the use of automated devices or processes are not allowed, and all such entries will be disqualified.
  8. Prize: The prize is a £1,000 gift card to a retailer of the winner’s choice located in Canary Wharf. This will be supplied as a digital gift card. The winner’s email address will need to be obtained by Canary Wharf Group to administer the prize.
  9. Winner Selection: One overall winner will be selected by a panel of judges with at least one independent judge. The criteria for selection will be creativity, quality, and relevance to the theme of nature and biodiversity in Canary Wharf. Additionally, approximately 100 photos will be selected for display in a lobby exhibition located in One Canada Square from September 30 to November 1, 2024.

This is to ensure the best possible quality for the exhibition prints.
  13. Limitations of Liability: No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Canary Wharf Group does not guarantee continuous uninterrupted or secure access to the website or Instagram. Numerous factors outside the control of the promoter may interfere with the operation of the website or social media platform.
  14. Publicity: The winners agree to reasonable post-event publicity by Canary Wharf Group with no further recompense.
  15. Legal Jurisdiction: Any questions concerning the legal interpretation of these terms & conditions will be based on English law and the Courts of England and Wales will have exclusive jurisdiction.

2. These pages, and the documents referred to in them (together, the “Terms and

Conditions”) are intended to tell you about us, our services, and our and your

responsibilities when you purchase parking services via our website or mobile

applications (“Site”).

3. If you purchase parking services through the Site, you’re agreeing to these

Terms and Conditions, so make sure you read through them carefully. You

should pay particular attention to the section called “Our Liability”, as this

excludes or limits our legal liability in connection with the payment of the

parking services.

4. If you do not agree to these Terms and Conditions, please do not purchase

parking services.

5. We update these Terms and Conditions from time to time, so remember to

check back in before you use or purchase parking services in case anything

has changed. If you purchase a Subscription, we will notify you of any material

changes to these Terms and Conditions by email. In continuing to use the

parking payment services on this Site you confirm that you accept the then

current terms and conditions.

Other Applicable Terms

1. When you purchase parking services through the Site, the Website Terms and

Conditions available on the Site (as updated from time to time) also apply to

your use of the Site.

2. By using the parking services, you also agree to be bound by and comply with

the Car Park Terms and Conditions displayed at the car parks and available on

the Site (as updated from time to time).

Parking Services

These Terms and Conditions shall apply to the following parking payment services

available through the Site:

1. when you make an advanced booking for a parking space (a “Pre-booking”);

2. when you purchase a monthly subscription for a parking space using the auto-

renewal option (a “Subscription”);

3. when you register on the Site to be automatically charged for parking in one of

our cark parks (“Auto-pay”).

Registration

1. To purchase parking services you must register on the Site by following the on-

screen instructions.

2. In order to become a registered user, you will have to provide some personal

information about yourself. Our Privacy Policy explains how we use the

personal information you provide to us on registration.

3. You agree that all information supplied on registration or otherwise during your

use of the parking services is true and accurate and will be kept up to date at all

times. We may use the information provided to us to contact you in relation to

your registration and to administer your Pre-booking, Subscription or Auto-pay

registration.

4. You may not have more than one registration and we reserve the right at our

discretion to delete or cancel the registration of any person who in our

reasonable opinion possesses more than one registration at any time.

5. You must not allow any other person to use your registration. You may not

impersonate any other person in any registration whether or not that other

person is a user of the Site or the parking services.

6. Select the parking services that best suit your needs. If you wish to purchase a

Subscription, you must ensure that the auto-renewal option is enabled on the

Site to keep your access to parking active without interruption.

7. Your registration will be complete when you have accepted these Terms and

Conditions. Once you have registered, you can use your selected car park by

driving in and out using our automatic number plate recognition system, you do

not need a ticket.

Auto-renewal

1. If you select the auto-renewal option:

a. your Subscription will automatically renew each month;

b. you agree that we can use your card details under a continuous payment

authority, which means we can automatically take an advance payment

each month for the parking services; and

c. your payment will be taken each month on the date immediately

following the expiry of your previous month’s Subscription.

2. If you do not want the Subscription to continue for another calendar month and

wish to cancel the continuous payments authority, you should terminate the

Subscription in accordance with the instructions set out below.

Auto-pay

1. When you register for Auto-pay you must register details of a valid debit or

credit card. No initial payment will be necessary, but you authorise us to

validate your payment details (this may include taking a hold transaction which

will be returned to you as soon as practicable).

2. You hereby authorise us to take payment from the payment card you have

registered on the Site for all amounts owing to us from you in respect of your

use of parking services at one of our car parks. Payment will be taken

automatically each time you use the parking services. Your use of parking

services will be monitored by our automatic number plate recognition system.

3. You will be charged for parking services in accordance with the current rate at

the time of use. These prices may change from time to time.

4. If you believe that there has been an error in taking a payment from your

registered payment card you must contact us as soon as possible so that we

can attempt to resolve the problem. If we cannot resolve the problem, you

should refer the problem to your card issuer.

Parking

5. If you have purchased a Pre-booking, you may only enter and exit the

designated car park on your booking once during your booked period of time.

6. Purchasing a Pre-booking or a Subscription or registering for Auto-pay does not

guarantee you a space in your selected car park. In the event that we cannot

provide a parking space in your selected car park for any reason, you will be

directed to an alternative car park. You will not have a reserved space in your

selected car park or priority over any other customers.

7. Canary Wharf Group reserves the right to withdraw or suspend the parking

services at a particular car park at any time for essential maintenance work or

unforeseen closures. If this happens, you will be directed to an alternative car

park.

Charges and payment

1. We currently accept payment for parking services by credit card and debit card.

Your booking confirmation is your receipt for payment.

2. Prices for the parking services are available on the Site. The prices may be

updated from time to time.

3. If we change the price of a Subscription, we will notify you in writing at least 14

days’ in advance of the next renewal date. The price increase will take effect

from the next renewal date following the service of our notice. If you do not

agree to the price change you may terminate the Subscription.

4. We reserve the right to deny access to a car park and cancel your Pre-booking

or Subscription if we do not receive payment in full from you in advance of the

time and date of your booking.

Cancelling your Pre-booking

1. If you wish to cancel your Pre-booking, you may do so by logging into your

registered account on the Site. Cancellations made more than 48 hours before

the entry time and date of your booking will receive a full refund.

2. No refund will be given for cancellations made 48 hours less before the entry

time and date of your booking.

Cancelling your Subscription

1. You can cancel your Subscription at any time during the first 14 days of your

Subscription. If you cancel during this period, you will be entitled to a

proportionate refund of any charges paid by you for the parking services

relating to the period after the termination date. We will make the refund within

14 days of the cancellation.

2. After this, you may cancel a Subscription at least 7 days’ prior to the next

renewal date. If you terminate the Subscription within 7 days of the next

renewal date, this may result in one additional payment, with the Subscription

ending the following month.

3. You can cancel your Subscription by logging into your registered account on the

Site and de-selecting the auto-renew option.

Cancelling Auto-pay

1. You can cancel your registration for Auto-pay at any time through the Site. Your

Auto-pay registration will be cancelled immediately. If you cancel your Auto-pay

registration, you will not be entitled to any refunds in relation to parking services

you have used on or prior to the cancellation date and time.

Our termination and cancellation rights

2. Canary Wharf Group may terminate your Pre-booking, Subscription or Auto-pay

registration at any time for any reason (including if your selected cark park

undergoes extensive work or is sold) by providing you with reasonable prior

written notice. If we terminate under this paragraph, you will be entitled to a

proportionate refund of any charges paid by you for the parking services

relating to the period after the termination date.

3. Canary Wharf Group may terminate your Pre-booking, Subscription or Auto-pay

registration (as applicable) immediately if:

a. you fail to pay for the Pre-booking or Subscription when the payment is

due;

b. you have registered for Auto-pay and your payment card fails when we

try to take a payment; or

c. in our reasonable opinion you have breached these Terms and

Conditions.

If we terminate in accordance with this paragraph, you will only be entitled to a

refund of any charges paid by you for the parking services where we consider

this to be reasonable.

4. If you do not use your Auto-pay registration for a period of more than 12

consecutive months, we reserve the right to terminate your Auto-pay

registration on reasonable prior written notice.

Our liability

1. As a consumer, you have certain rights under law and nothing in these Terms

and Conditions can, or is intended to, limit or remove these rights. We don’t

exclude or limit our responsibility to you for loss or damage where it would be

unlawful to do so including for death or personal injury caused by our

negligence or for fraud or fraudulent misrepresentation by us.

2. Except for the liability we cannot exclude or limit as mentioned above, we shall

only be liable to you (including for negligence) under any and all claims in

connection with the Pre-booking, Subscription or Auto-pay service up to the

greater of: a) the amount paid by you for the Pre-booking, Subscription or for

parking services using the Auto-pay service giving rise to the claim or b) £500.

3. We will not be liable to you in connection with the Pre-booking, Subscription or

Auto-pay service (including for negligence) for any loss of reputation you suffer

or any business losses including loss of revenue, profit or opportunity.

4. We will not be liable to you for any breach of these Terms and Conditions

caused by circumstances beyond our reasonable control.

5. Although we aim to offer you the best service possible and will act with

reasonable care and skill, we make no promise that the Pre-booking,

Subscription or Auto-pay service will meet your requirements or will be fault-

free.

Governing law

1. These Terms and Conditions are governed by English law.

2. The courts of England and Wales have jurisdiction to hear any disputes about

these Terms and Condition, and any dealings between you and us, unless you

live in another part of the United Kingdom in which case any disputes may be

brought in the jurisdiction where you live.
